Terms and Conditions

These Terms and Conditions govern your use of Customodoro. They are intended to set clear, reasonable rules for a free, local-first productivity timer and its installable Progressive Web App.
Acceptance of these terms
By accessing or using Customodoro, you agree to be bound by these Terms and by the Privacy Policy. If you do not agree, please do not use the service.
“Customodoro,” “we,” “us,” and “our” refer to the Customodoro service operated by Brian Yabut as YabuTech in the Philippines.
What Customodoro provides
Customodoro provides Classic Pomodoro and Reverse Pomodoro timers, task tools, timer settings, local productivity history, themes, sounds and music, achievements, educational material, browser notifications, and PWA/offline functionality.
- An account is optional. The timer works fully without one.
- Local storage: most settings and productivity information are stored in your browser.
- Offline use requires a successful first load and depends on browser storage and service-worker support.
- Notifications require browser and operating-system permission and may not fire reliably when a device restricts background activity.
- Clearing browser storage, using private browsing, changing browser profiles, or uninstalling the PWA may remove local data.
An optional free account adds cross-device sync and the leaderboard. The leaderboard is public: the display name on your account and your focus totals are visible to anyone who opens it. Choose a display name you are comfortable showing publicly, and do not impersonate another person or organization.
Your content and account data
You keep ownership of task text, descriptions, settings, and other content you create. You give us only the limited permission needed to display and process that content on your device and, if you use an account, to store and synchronize it as described in the Privacy Policy.
You are responsible for your content and for keeping your device and browser profile secure. Do not enter content that is unlawful, infringes another person's rights, or contains passwords, government identifiers, financial credentials, health records, or other information requiring stronger safeguards than a personal timer is designed to provide.
Account holders may request access, export, correction, or deletion by emailing brianyabutech@gmail.com.
Acceptable use
You may not use the hosted service to:
- break the law, encourage unlawful conduct, or violate another person's rights;
- impersonate another person or misrepresent your connection to Customodoro;
- probe, bypass, or obtain unauthorized access to accounts, systems, data, or security controls;
- introduce malware, overload the service, interfere with operation, or disrupt other users;
- scrape or automate requests in a way that harms the service or bypasses reasonable technical limits; or
- use Customodoro branding to suggest sponsorship or endorsement without written permission.
These hosted-service rules do not take away rights granted under the MIT License for source code covered by that license.
Ownership, open-source code, and media
Customodoro service and branding
Customodoro's name, branding, original visual design, original written material, and other non-open-source materials are owned by YabuTech or used with permission. These Terms do not transfer those rights to you.
MIT-licensed source code
Source code identified in the public repository as covered by the MIT License remains governed by that license. The MIT License may allow copying, modification, distribution, sublicensing, and commercial use subject to its notice and warranty terms. If these Terms conflict with the MIT License for covered code, the MIT License controls for that code.
Music, audio, artwork, and third-party material
Music, recordings, album art, fonts, research references, and other third-party materials remain owned by their respective rights holders and are used under applicable permissions or licenses. Access through the hosted app does not grant permission to extract, redistribute, sell, publicly perform, or reuse those materials outside the app unless the relevant rights holder or license separately permits it.
Third-party services and links
Customodoro may link to external resources, including the optional NoteForms feedback form, LinkedIn, research sources, another YabuTech app, and provider or open-source pages. External services are controlled by their operators. We are not responsible for their content, availability, security, or privacy practices. Review their terms before using them.
Availability, suspension, and changes
We may maintain, update, change, suspend, or discontinue all or part of Customodoro. Features can fail because of browser limits, device settings, connectivity, provider outages, bugs, or other circumstances. We do not promise uninterrupted availability or preservation of local browser data.
We may block access to the hosted service when reasonably needed to protect users, systems, legal rights, or service reliability, or when these Terms are materially violated.
Important disclaimers
Customodoro is a general productivity tool. It is not medical, mental-health, educational, employment, financial, or other professional advice. Timer intervals, streaks, points, sounds, research summaries, and focus techniques may not suit every person or situation. Stop or adjust your use if it causes discomfort, unsafe distraction, or unhealthy work patterns.
To the extent permitted by law, the hosted service is provided “as is” and “as available,” without warranties that it will be error-free, secure, uninterrupted, fit for a particular purpose, or produce specific productivity, health, academic, or professional results. Rights and warranties that cannot lawfully be excluded remain unaffected.
Limitation of liability
To the fullest extent permitted by applicable law, YabuTech will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from your use of or inability to use the service, including lost productivity, lost opportunities, or loss of locally stored data.
Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability arising from fraud, willful misconduct, or other non-excludable obligations. The MIT License separately states the warranty and liability terms for code covered by that license.
Governing law and disputes
These Terms are governed by the laws of the Republic of the Philippines, without overriding mandatory consumer protections that apply where you live. Before starting formal proceedings, please contact us and make a good-faith effort to resolve the concern. Disputes that cannot be resolved will be submitted to a court of competent jurisdiction in the Philippines, unless applicable law requires another forum.
If any part of these Terms is held invalid or unenforceable, it will be limited or removed only to the extent necessary, and the remaining parts will continue to apply. A failure to enforce a provision is not a waiver of it.
Changes and contact
We may update these Terms to reflect service, legal, or security changes. We will update the “Last modified” date and provide an appropriate notice for material changes. Continued use after the updated Terms take effect means you accept them, except where law requires a different form of agreement.
